Prayagraj, 11 September (HS). Allahabad High Court has refused to grant bail to the accused of kidnapping a 12-year-old minor from a farm in Kakwan police station area of Kanpur city and committing the inhuman act of rape. It has been said that the crime is heinous and violates humanity. The victim was treated for 15 days, she is in shock.
This order has been given by Justice Krishna Pahal while rejecting Kuldeep's bail plea. The victim was inhumanly raped on 29 November 2020. She suffered serious injuries and was operated upon. The victim has given details of the incident in her statement and has identified the accused.
The petitioner said that he has been falsely implicated due to a dispute over money transactions. It is clear from the victim's statement that the police tortured her. Therefore, her statement is not reliable. During the trial, the doctor said that the victim was referred to the CMO for age determination. But no medical report is on file. The petitioner has been in jail for the last four years since 1 December 2020. Therefore, he should be released on bail, but the court refused to grant bail considering the nature and gravity of the crime.
