High court shocked by decisions of civil court, advises judges to undergo training | News India

Prayagraj, 05 September (HS). Allahabad High Court expressed surprise at the decisions taken by the Junior Division Civil Judge and Fast Track Court District Judge in Mainpuri and suggested that both the judges need further training.

The court made this remark while hearing the second appeal filed in the High Court by Shailendra alias Shankar Verma in connection with the disputed property case. Justice Kshitij Shailendra reviewed the decisions of the Mainpuri Civil Court involved in the civil case of the second appeal filed in the High Court.

The High Court observed a clear lack of understanding on the part of the junior division civil judge on how to properly understand the defences filed in the case. The High Court said it was surprising that the defence produced two witnesses whose testimony was not considered at all, indicating a possible lapse in the trial procedures.

The court found that neither the plaintiff's claims nor the counter-claims were properly addressed in the civil court's decision. Due to which the conclusions appear meaningless. The court said that according to the decision, the defendant's suit was dismissed without proper consideration of the arguments presented.

Equally surprising was the performance of the District Judge of Room No. 2 of Mainpuri Court, who failed to understand the proceedings properly. The High Court said in its remark that it seems that both the courts have failed to perform their duties as civil courts. They are only completing the formalities of writing the judgment without any proper reason. Making the above remark, the High Court has accepted the second appeal for further hearing and issued notice to the opponents.
