Chief Justice of India NV Ramanna had expressed displeasure over the government repeatedly filing PILs in the Supreme Court on such issues instead of addressing politically sensitive issues. Addressing the government, he said, ‘If the Supreme Court has to solve all the problems then why the Lok Sabha and the Rajya Sabha? The Chief Justice expressed displeasure over the application of advocate Ashwini Upadhyay for the public interest in the deportation of illegal immigrants. He remarked that the burden of the court was being increased by repeatedly bringing such political issues before the Supreme Court.

“If I agree and order the hearing of the petition on all issues that can be politically resolved, what will the elected political representatives in Lok Sabha and Rajya Sabha do?” Why are they chosen? He asked the important question whether the court should now pass all the bills and resolutions. Advocate Ashwini Upadhyay had filed a petition seeking identification and segregation of all illegal immigrants within a year, ordering the government to arrest and deport them.

The court had earlier on January 31, 2018, directed Upadhyay to link his application with the application of two Rohingya refugees. The counsel for the Central Government was asked to provide a copy. The CJI got annoyed when Upadhyay on Thursday sought an urgent hearing on the issue and said, “Mr. Upadhyay, do I have to hear your case every day?
